Heard learned counsel for the applicant, learned AGA for the State and perused the record.

It is contended on behalf of the applicant that the applicant has been falsey implicated. The F.I.R. has been lodged after a delay of five days and the medical examination has been conducted after ten days.

Learned A.G.A. has opposed the bail prayer submitting that the victim is seven years of age. In his statement under Section 164 Cr.P.C., he supported the prosecution story and levelled specific allegations against the applicant. Medical report corroborates the statement under Section 164 Cr.P.C. as well as F.I.R. He lastly submitted that the bail application is liable to be dismissed.

In view of the above, the bail application of the applicant who involved in case crime No. 276/2018, under Section 377 I.P.C. and Section 5/6 of Protection of Children From Sexual Offences Act, Police Station Kotwali Utraula, District Balrampur, is rejected.
