Judgments of Supreme Court of India and High Courts

Namita vs Rajender on 21 November, 2019

IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH
FAO-2764-2019
Date of decision : 21.11.2019
Namita ….Appellant

V/s
Rajender ….Respondent

CORAM: HON’BLE MR. JUSTICE RAJAN GUPTA
HON’BLE MRS. JUSTICE MANJARI NEHRU KAUL

Present: Mr. Gopal Sharma, Advocate for the appellant.

Mr. Aman Arora, Advocate for the respondent.

RAJAN GUPTA J. (ORAL)

Present appeal is directed against the order passed by court

below whereby it has accepted the application under Sectionsection 24 of the Hindu

Marriage Act and granted `10,000/- as maintenance pendente lite and

litigation expenses to the tune of `11,000/-.

We find that the maintenance granted is on the lower side as

respondent is a Havildar and is drawing a salary of `51,292/-. Under the

circumstances, we enhance the maintenance to `14,000/- per month and

disposed off the appeal.

Counsel for the appellant has also raised a plea that

maintenance pendente lite ought to have been granted from the date of

application. We do not wish to express any opinion on this issue. However,

counsel for the appellant shall be at liberty to move appropriate application

before the court below in this regard which may be decided at the stage of

final arguments.
