04/13.03.2019 Heard learned counsel for the parties.
The petitioner is an accused in a case registered for the offence
punishable under Section 377 IPC and Section 4 of the POCSO Act.
Learned counsel for the petitioner submits that the petitioner has been
falsely implicated in this case and has not committed any offence, as alleged in
the F.I.R. There is no eye-witness to the alleged occurrence. The entire story
made out by the informant in his written report is concocted. The petitioner is in
judicial custody since 07.05.2018 and therefore he may be given the privilege of
Learned A.P.P opposed the petitioner’s prayer for bail.
Considering the nature of the allegation against the petitioner, I am not
inclined to grant bail to the petitioner in connection with S.T. No. 35/2019,
arising out of Daltonganj Town P.S. Case No. 154/2018 (POCSO Case No.
Accordingly, the prayer for bail of the above named petitioner is rejected.
