Shri Kamal Jain, learned Public Prosecutor for the
respondent-State.

Heard on admission.

Appeal is admitted for final hearing.
Record of the trial Court be called for.
Heard on IA No.5920/18 under Section 389 (1) of
Cr.P.C., which is first application for suspension of sentence
and grant of bail to the appellant.

Appellant has been convicted and sentenced to 02
years’ RI under Section 457 IPC with fine of Rs.600/- and in
default of fine three months’ RI and 03 years’ RI under
Section 354 IPC read with Section 8 of POCSO Act with fine
of Rs.600/- and in default of fine three months’ RI.

It is submitted by the learned counsel for the appellant
that sentence of the appellant has been suspended by the
trial Court itself till 20.08.2018. Amount of fine has been
deposited by the appellant and final hearing of the appeal is
likely to take time. On such premises, learned counsel prays
for suspension of sentence.

The prayer is opposed by the learned Public
Prosecutor.

Considering the facts and circumstances of the case,
but without commenting anything on the merits of the case,
IA No.5920/18 is allowed and subject to verification of
depositing the fine amount, remaining jail sentence of the
appellant is hereby suspended. It is further directed that on
furnishing a personal bond of Rs.50,000/- (Rs. Fifty

Thousand Only) alongwith two sureties of the like amount to
the satisfaction of the trial Court, the appellant shall be
released on bail with a direction to remain present before the
concerned CJM on 08.01.2019 and on subsequent dates as
may be fixed by the concerned CJM from time to time, which
shall not be more than twice a year, till final adjudication of
this appeal.
