Judgment / Order


The instant misc. petition under Section 482 Cr.P.C. has been

filed by the petitioner for quashing of FIR No.229/2019, Police

Station Banar, Jodhpur for offences under Section 354 IPC.

Counsel for the petitioner submits that entirely a false and

frivolous case has been registered against the petitioner. It is

further submitted that the Investigating Officer is not recording

the statement of independent witness, therefore a direction may

be issued to the Investigating Officer to record the statement of

independent witness.

After hearing learned counsel for the petitioner and taking

into consideration the material available on record, I am not

inclined to quash the FIR. However, liberty is granted to the

petitioner to file representation alongwith relevant documents

before the concerned Investigating Officer within a period of

fifteen days. The Investigating Officer shall take up all the facts as

well as representation, if any, filed on behalf of the petitioner and

complete the investigation by considering them strictly in

accordance with law within a period of one month from the date of

filing of the representation.

The instant misc. petition filed by the petitioner is disposed

of accordingly.

Stay petition is also disposed of.
