Judgments of Supreme Court of India and High Courts

No. 19 vs Deb Smt. Somdatta Raychaudhuri on 9 December, 2019

C.O. 4015 of 2019
no. 20 Sri Anindya Chatterjee
no. 19 – Vs –

Deb Smt. Somdatta Raychaudhuri

Mr. Bratin Kumar Dey
Mr. Nilanjan Pal
… for the petitioners

The petitioner before this court filed MAT Suit No. 31 of 2015 which is pending before the

learned Additional District Judge 11th Court, Alipore, South 24 Parganas. The petitioner prays for

expeditious disposal of MAT Suit No. 31 of 2015 and further prays that as the petitioner is

working in the USA, the cross-examination should be completed on a day to day basis.

Having considered the submission and having perused the record, in my opinion, justice

will be subserved if the learned Court below, that is, the Additional District Judge, 11th court,

Alipore, South 24 Parganas is requested to dispose of MAT Suit No. 31 of 2015 as expeditiously

as possible within preferably a period of six months from the date of passing of this order. It is

also expected that in view of the service condition of the petitioner the cross-examination should

be held on a day to day basis as per the convenience of the learned Court below.

The revisional application is disposed of. There will be no order as to cost.

This order will not bind the court in case the petitioner fails to pay the maintenance

pendente lite as directed by the learned Court.

The petitioner is directed to serve a copy of this application upon the opposite parties by

registered speed post with acknowledgement due along with the server copy of this order.

Urgent Photostat certified copy of this order, if applied for, be given to the

parties on priority basis.
