The husband in Matrimonial Suit No.2141 of 2016

pending before the learned Additional District Judge, 4th

Court, Barasat, District – 24 Parganas (North) has

preferred this revisional application praying for

expeditious disposal of the matrimonial suit as also the

Misc. Case No.8 of 2019. Misc. Case No.8 of 2019 is an

application for maintenance under Section 24 of the

Hindu Marriage Act.

It is submitted that the said misc. case is pending

and adjournments are being granted in a routine manner.

Under such circumstances, without going into the

merits of the claim of the petitioner, this revisional

application is disposed of with a direction upon the

learned Additional District Judge, 4th Court, Barasat,

District – 24 Parganas (North) to dispose of Misc. Case

No.8 of 2019 as expeditiously as possible, preferably

within a period of two months from the date of

communication of this order.

If the husband continues to pay the maintenance

pendente lite, as may be directed by the Court below, then

Matrimonial Suit No.2141 of 2016 should be disposed of

preferably within four months from the date of disposal of

Misc. Case No.8 of 2019.

It is made clear that if the husband does not pay

maintenance pendente lite, as directed by this Court, then

the learned Court below will not be bound by this order.

The petitioner is directed to serve a copy of this

application upon the opposite party along with a server

copy of the order.

Urgent Photostat Certified copy of this order, if

applied for, be supplied expeditiously after complying with

all necessary legal formalities.
