Vide impugned order dated 22.02.2014, the Guardian Judge,

Kapurthala has allowed petition under Section 7 of the Guardian Wards

Act, 1890 filed by respondent Mangal Singh appointing him as guardian of

the minor Komal Preet Kaur to look after her and for her upbringing and

education by providing her all the amenities of life.

Aggrieved by the said judgment and decree, the appellant has

preferred this appeal.

During pendency of the appeal, the parties were referred to the

Mediation and Conciliation Centre. Parties have arrived at a settlement,

copy of which signed by both the parties is taken on record as Ex. CX. As

per the terms of the said settlement, it has been agreed between the parties

that the appellant being father of the minor child and the respondent being

maternal grandfather of minor child Komal Preet Kaur, the appellant will be

entitled to exercise his visitation rights by meeting the child on first Sunday

of every month between 10:00 AM to 05:00 PM and shall stay with her in

the presence of her maternal grandparents. Certain terms pertaining to

festivals have been settled. Some opportunities have been granted to the

appellant to give any gift, toys etc. to the minor child.

The settlement Ex.CX is taken on record and the appeal is

disposed of on the basis of said settlement.

It is ordered that the parties will be bound by the terms of the

settlement in Ex.CX. In case of any violation, it will be open the aggrieved

party to seek the execution or an order under Section 43 of the Guardian and

Wards Act for regulating an enforcement of the orders as per the terms of

agreement Ex.CX.

Order will remain operative till the minor attains majority.
