In Re:- An application for bail under Section 439 of the Code of
Criminal Procedure filed on 31.01.2018 in connection with
Daspur P.S. Case No.268 of 2016 dated 09.10.2016 under
Sections 498A/304B/34 of the Indian Penal Code and Section 3/4
of the Dowry Prohibition Act.

Leave is granted to correct the cause title of the petition.

The father of the petitioner is present in person and submits

that the petitioner who is the brother-in-law of the victim

housewife is in jail for four and half months and the other

accused persons are on bail.

The Investigating Officer is present in person and produces

the Case Diary.

We have considered the materials collected in the course of

investigation.

Having considered the cause of death as transpiring from the

medical papers and the extent of complicity of the petitioner in the

alleged crime and the fact that the co-accused persons are already

on bail, we are inclined in granting bail to the petitioner.

Accordingly, the petitioner, namely Panchanan Sau shall be

released on bail upon furnishing a bond of Rs.10,000/- with two

sureties of like amount one of whom must be local to the

satisfaction of the learned Additional Chief Judicial Magistrate,

Ghatal Paschim Medinipur subject to condition that the petitioner

shall appear before the trial court on every date of hearing and

shall not intimidate witnesses or tamper with evidence in any

manner whatsoever.

In the event, the petitioner fails to appear before the Trial

Court without any justifiable cause, the trial Court shall be at

liberty to cancel his bail in accordance with law without further

reference to this Court.

The application, being C.R.M.957 of 2018, is disposed of.
