2 04-01-2019 This is an application for grant of anticipatory bail in

connection with Complaint Petition Vide C.R. No. 910/2017,

T.R. No. 2809/2017, disclosing offences under Sections 323,

504, 354, 379, 498(A), 342, 494, 147 of the Indian Penal Code,

Section 3, 4 of Dowry Prohibition Act and Section 3, 4 of Dayan

Act.

Allegation as per the complaint petition is that the

petitioner has tried to misbehave with the complainant, who

happens to be his Bhabhi. There is also allegation of cruelty and

torture against the family members of the petitioner to the

informant.

Submission of learned counsel for the petitioner is

that he is the Devar of the complainant and only allegation

against him is that he tried to misbehave with the complainant

and no offence under Section 354 IPC is made out against the

petitioner.

Heard learned A.P.P. also.

Having heard both sides, considering the above

submission, this application is allowed. Let the petitioner, above

named, in the event of his arrest or surrender before the court

below within six weeks, be released on bail on furnishing bail

bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two

sureties of the like amount each to the satisfaction of learned

S.D.J.M., Madhubani, in connection with Complaint Petition

Vide C.R. No. 910/2017, T.R. No. 2809/2017, subject to the

condition laid down under Section 438(2) of the Code of

Criminal Procedure.
