This is an application, filed under Section 438 Cr.PC, praying for pre-arrest bail of
the petitioner, namely, Parama Saikia, in connection with Gohpur PS Case No.
64/2019 under Sections 354/354(B)/341/294/506 IPC.
Heard Mr. S. Munir, learned counsel for the petitioner as well as Mr. N.J. Dutta, learned
Additional Public Prosecutor for the state respondent.
Case diary produced has been perused including the statement of the victim as well as
the co-lady worker of the victim in the same office.
There are sufficient incriminating materials against the petitioner collected in respect of
an offence, particularly offence under Section 354 IPC. The petitioner is in-charge
Block Development Officer and the victim lady is an Extension Officer working under
him at the relevant time of occurrence in the same office. Considering the nature of
the offence, this is not a fit case for grant of privilege of pre-arrest bail to the petitioner,

and accordingly, his prayer is rejected.

Interim pre-arrest bail granted to the petitioner vide order, dated 26.2.2019, stands
vacated.

The petition stands disposed of.
