1. The petitioner seeks grant of anticipatory bail in respect of a case

registered against him vide FIR No.203, dated 6.9.2018, registered at

Police Station Bond Kalan, District Charkhi Dadri, under Section 406

IPC.

2. The allegations, in nutshell, are that on 6.9.2018, one person came to

Ganesh Petrol Pump, Dadri, in a silver coloured car bearing

registration No.HR-99 C1 (TEMP)-0260 make Volkswagen and got

three cans filled with diesel and also got the fuel tank of his car filled

up but went away without making the payment of `13,500/-.

3. Learned counsel for the petitioner has submitted that he is not

specifically named in the FIR and does not own the car the

registration number of which is mentioned in the FIR.

4. Opposing the petition, learned State counsel has submitted that the

petitioner has since joined investigation and that two cans filled with

diesel have been recovered from the petitioner which fully

substantiate the allegations levelled in the FIR.

5. Having considered rival submissions addressed before this Court and

bearing in mind the nature of allegations and the amount involved in

the FIR and that the petitioner is not specifically named in the FIR, in

my opinion, it is a fit case for grant of anticipatory bail. The petition

is as such accepted and interim directions issued vide order dated

27.9.2018 are made absolute subject to the condition that the petitioner

shall appear and join the investigation as and when called upon to do

so and cooperate with the Investigating Officer and shall abide by the

conditions as provided under Section 438 (2) Cr.P.C.
