The petitioner has preferred this revisional application praying for

quashing of the proceedings being Belgharia Police Station Case No. 68 of 2017

dated January 20, 2017 under Sections 498A/Section323/Section325/Section506 IPC pending before

the Court of the learned Additional Chief Judicial Magistrate, Barrackpore, North

24-Parganas.

Both the petitioner and the opposite party no. 2 have filed one joint application being

CRAN 1143 of 2019 praying for quashing of the aforesaid criminal proceedings on the grounds

that the dispute is settled amicably between the parties and that no fruitful purpose will be

served in continuation of the criminal proceedings. The said joint application is supported by the

affidavit of the petitioner and the affidavit of the opposite party no. 2.

Having heard learned counsel for the petitioner, learned counsel for the opposite party no.

2 and learned counsel for the opposite party no. 1/State, I am inclined to quash the instant

criminal proceeding because the dispute is settled amicably between the parties and the dispute

is private in nature and the same will not have much impact on the society.

Accordingly, the criminal proceeding being G.R. 1270 of 2017 arising out of Belgharia

Police Station Case No. 68 of 2017 dated January 20, 2017 under Sections 498A/Section323/Section325/Section506

IPC pending before the Court of the learned Additional Chief Judicial Magistrate, Barrackpore,

North 24-Parganas is quashed.

Thus, the revisional application being CRR 867 of 2019 and the application being CRAN

1143 of 2019 are disposed of.

The department is directed to send down a copy of this order to the learned Court below

for favour of information and necessary action.

Urgent photostat certified copies of this order, if applied for, be made

available to the parties upon compliance of all legal formalities.
