This is an application for quashing of a proceeding in

which the chargesheet was submitted under Section 498A of the

Indian Penal Code.

The Learned Advocate appearing on behalf of the

petitioner submits as follows. The present proceeding was initiated

by the opposite party no.2/father-in-law of the petitioner. During

pendency of the impugned proceeding, a settlement and

compromise was arrived at between the private parties at the

instance of a common friends and relations. The private parties

pray that the impugned proceedings may be quashed on the

ground of such settlement and compromise.

The Learned advocate appearing on behalf of the opposite

party no.2 supports the contentions of the learned advocate

appearing for the petitioner on the score that the settlement and

compromise have been arrived at between the private parties. He

further submits that a joint compromise application has been filed

praying for quashing of the impugned proceeding on the ground of

settlement and compromise.

Let the petitioner serve a copy of this application upon the

State through Learned Public Prosecutor within a week and file an

affidavit of service to that effect on the next date of hearing.

Let this matter appear as a “Contested Application” two

weeks hence.

The impugned proceeding shall remain stayed for a period

of four weeks from this date.

The parties shall be at liberty to pray for extension or

modification or vacating of the interim order upon notice to the

other sides.

As per the submissions made by the learned advocate for

the private parties and in the interest of justice, the present

revision application may be listed along with CRR 864 of 2019.

Urgent photostat certified copy of this order, if applied for,

be supplied to the parties on compliance of necessary formalities.
