The present bail application has been filed under Section 439

Cr.P.C. on behalf of the petitioner, who is in custody in relation to

F.I.R. No.215/2015, Police Station Rohat, District Pali, for the

offences under Sections 377 IPC and Section 3/4 of POCSO Act.

Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

Having considered the arguments advanced by learned

counsel for the petitioner and keeping in view the gravity and

nature of allegation, I am not inclined to grant bail to the

petitioner. Consequently the bail application filed by the petitioner

[CRLMB-5430/2016]

is dismissed. However, he is given liberty to file fresh bail

application after the victim is examined at the trial.
