ORDER
Petitioner is the accused in crime no.467/2018 of
Shornur police station. She allegedly committed an offence
punishable under Sec.498A of IPC. She seeks bail under
Sec.438 of Cr.P.C.
2. Prosecution case is as follows: A woman by
name Anjana committed suicide. She set herself ablaze on
13.5.2018 at her father’s house. She died 1½ months
thereafter. She was the daughter-in-law of the petitioner.
The petitioner had been harassing her daughter-in-law. The
former thereby committed an offence under Sec.498A of IPC.
3. Heard Sri.M.Sasindran, the learned counsel for
the petitioner and Sri.D.Chandrasenan, the learned public
prosecutor.
4. A young woman committed suicide. She set
herself ablaze on 13.5.2018 at her parental house. She died
1 ½ months after the said incident. Her mother-in-law is
indicted. The woman by name Anjana who committed
suicide gave a statement to the magistrate under Sec.164 of
Cr.P.C after the incident of her burning herself. I am shown
the copy of the said statement by the public prosecutor. It
appears to me prima facie that sufficient materials are not
available in the said statement against the petitioner. I
therefore allow the application.

5. The application is allowed. If arrested in
connection with crime no.467/2018 of Shornur police station,
the petitioner shall be released on bail after interrogation, if
any, on her executing a bond for Rs 50,000/-(fifty thousand
only) with two solvent sureties each for the like sum to the
satisfaction of the investigating officer. The petitioner shall
co-operate with the investigation. She shall make herself
available for interrogation if so required by the investigating
officer. The petitioner shall report to the investigating officer
between 10 a.m and 11 a.m on every Wednesday for a
period of three months or till the filing of the final report,
whichever is earlier. The petitioner shall not intimidate or
attempt to influence witnesses. Nor shall she destroy
evidence or tamper with it. She shall not attempt to
interfere with the investigation. The court having jurisdiction
is hereby empowered to cancel the bail in accordance with
law if any of the conditions mentioned above is violated by
the petitioner. If the petitioner chooses to surrender before
the magistrate, this order shall have no effect and the
learned magistrate will pass appropriate orders as if this
order has not been passed.
