2 02-07-2018 Heard both sides.

The petitioner apprehends his arrest in Bajpatti P.S.

Case No.209 of 2016 registered under Sections 341, 323, 324,

354, 504, 379, 34 of the Indian Penal Code.

The informant alleged that while she was sitting on her

darwaza, the petitioner came and asked to withdraw the case

lodged by her husband. The informant replied that till she got her

path, she would not withdraw the case. It is alleged that the

petitioner drew her sari and consequently the informant became

semi naked. On the order of the petitioner, Jairam Bhagat is

alleged to have assaulted Sunita Devi, the sister-in-law of the

informant.

The learned counsel for the petitioner submits that on

account of land dispute, the informant is making false allegation.

There is no allegation of assault against the petitioner. All the

offences are bailable save and except Section 354 I.P.C.

Taking into consideration the facts that some dispute

arose due to egress and ingress between both sides on which some

altercation took place, the petitioner, above named, in the event of

his arrest or surrender before the learned court below within a

period of four weeks from the date of receipt/production of a copy

of this order is directed to be enlarged on bail on furnishing bail

bond of Rs.10,000/-(Ten thousand) with two sureties of the like

amount each to the satisfaction of learned S.D.J.M., Pupri at

Sitamarhi in connection with Bajpatti P.S. Case No.209 of 2016,

subject to conditions as laid down under Section 438(2) of the

Code of Criminal Procedure.
