The present fourth bail application has been filed under

Section 439 Cr.P.C. on behalf of the petitioner, who is in custody in

relation to F.I.R. No.37/2017, Police Station Sayala District Jalore,

for the offences under Sections 498-A 325 IPC.

Heard learned counsel for the parties. Perused the material

available on record.

The previous bail application No.10164/2017 filed on behalf

of the petitioner was rejected by this Court on 13.11.2017.

However, the trial court was directed to conclude the trial within a

period of six months.

Shri Mehta, Advocate representing the accused petitioner in

this fourth bail application points out that not even a single

witness has been examined after rejection of the petitioner’s

previous bail application because the matter is pending in a

revision filed by the co-accused who were summoned by the trial

court by exercising powers under Section 319 Cr.P.C.

This statement given by Shri Mehta is not controverted by

Shri Suresh Kumbhat representing the complainant as well as

learned Public Prosecutor.

The accused petitioner is in custody for the last 17 months

for the offences under Sections 325 498A IPC which carry a

maximum sentence of seven years. Furthermore, the trial of the

case is lingering on for no fault of the accused petitioner.

In this background and having regard to the facts and

circumstances available on the record, but without expressing any

opinion on the merits of the case, I am of the opinion that the

petitioner deserves to be released on bail.

Accordingly, this fourth bail application is allowed and it is

directed that the petitioner Praveen Singh S/o Shri Ram Singh

arrested in connection with the F.I.R. No.37/2017, registered at

Police Station Sayala, District Jalore shall be released on bail

provided he furnishes a personal bond of Rs.50,000/- and two

surety bonds of Rs.25,000/- each to the satisfaction of the learned

trial court with the stipulation to appear before that Court on all

dates of hearing and as and when called upon to do so.
