Apprehended for offences punishable under Section 354 IPC

and Section 7/8 of the POCSO Act pursuant to FIR No.110/2017 of

Dechu Police Station, District Jodhpur, petitioner has laid this bail

application under Section 439 Cr.P.C.

It is argued by learned counsel for the petitioner that he has

been falsely implicated and there is no tangible ground to connect

him with the commission of offence. Learned counsel has also

urged that although victim (Prosecutrix) has attributed role to the

petitioner under Section 164 Cr.P.C. but in the backdrop of facts

and circumstances, prima facie, offence under Section 354 IPC is

under serious cloud.

Learned Public Prosecutor has vehemently opposed bail

application of the petitioner.

Having heard learned counsel for the parties and taking into

account facts and circumstances of the case, without expressing

any opinion on merits of the case, I deem it just and appropriate

to grant indulgence to the petitioner by enlarging him on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner, Prema Ram @

Kalu Ram S/o Shri Rewant Ram, arrested in connection with F.I.R.

No.110/2017, Police Station Dechu, District Jodhpur, may be

released on bail; provided he furnishes a personal bond of

Rs.50,000/- with two sureties of like amount to the satisfaction of

learned trial Court with the stipulation to appear before that Court

on all dates of hearing and as and when called upon to do so.
