Priyanka Makhal vs Unknown on 18 May, 2018

C.R.M. 2994 of 2018

In Re:- An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 17.05.2018 in connection
with Amta P. S. Case No.511 of 2017 dated 18.11.2017 under
Sections 498A/304B/306/34 of the Indian Penal Code.

In the matter of : Priyanka Makhal.

… Petitioner.

Mr. Maidul Islam Kayal,
Mrs. Karabi Ray.

…for the Petitioner.

Mr. Swapan Banerjee,
Mr. Suman De.

…..for the State.

Heard the learned Counsel appearing on behalf of the

petitioner and the State.

It is submitted on behalf of the petitioner that she is the

sister-in-law of the victim housewife and has been falsely

implicated in the instant case. It is also submitted that the victim

had committed suicide in her parental home.

Learned Advocate appearing for the State produces the Case

Diary and opposes the prayer for bail.

Having considered the materials on record and bearing in

mind the extent of complicity of the petitioner in the ill-treatment

of the housewife and in view of the contradictory versions with

regard to the extent of complicity of the petitioner in the torture of

the housewife on the day prior to the incident as transpiring from

the first information report and the subsequent statement of the

defacto complainant, we are inclined to grant anticipatory bail to

the petitioner.

Accordingly, we direct that in the event of arrest, the

petitioner, namely, Priyanka Makhal Roy shall be released on bail

upon furnishing a bond of Rs.10,000/- with two sureties of like

amount to the satisfaction of the arresting officer and subject to

the conditions as laid down under Section 438(2) of the Code of

Criminal Procedure, 1973.

This application for anticipatory bail is, thus, disposed of.
