It is submitted by the learned Counsel appearing for the

petitioners that the petitioner no. 1 is not a relation of the opposite

party no. 2 and has been falsely implicated in the instant case.

Ingredients of the alleged offences are not disclosed.

Let this matter appear under the heading “Motion Adjourned”

two weeks hence.

Ms. Snehanabis, learned Counsel, who ordinarily appears for the

State, is directed to appear in this matter for the State. Let copy of this

application be served upon her in Court today. Learned Counsel is

also directed to produce the Case Diary on the next date of hearing.

Let copy of this revisional application be served upon the

opposite party no. 2 through registered speed post with

acknowledgement due and affidavit-of-service be filed on the next date

of hearing.

There shall be stay of operation of the impugned proceeding in

connection with G.R. Case No. 2729 of 2015 arising out of Bagnan

Police Station Case No. 457 of 2015 dated 11.12.2015 under Sections

498A/406/34 of the Indian Penal Code subsequently charge-sheeted

under Sections 498A/406/34 of the Indian Penal Code read with

Section 3 and 4 of the Dowry Prohibition Act, pending before the Court

of the learned Additional Chief Judicial Magistrate, Uluberia, Howrah,

so far as it relates to the petitioners, for a period of six weeks from

date or until further orders, whichever is earlier.

Proceeding against the other accused persons shall, however,

continue in accordance with law.

Liberty is given to the parties to pray for extension and/or

vacation and/or modification of this order upon notice to the other

side.

Photostat certified copy of this order, if applied for, shall be given

to the parties as expeditiously as possible on compliance of all

necessary formalities.
