In th matter of : Kanchan Dhibar Ors. … Petitioners
Mr. Arindam Roy …. for the Petitioners
Mr. Saswata Gopal Mukherjee
Mr. N. Ahmed
Mr. Anowar Hossain …..for the State
The petitioners undertake to affirm and stamp the petition
as per the Rules within 48 hours of resumption of normal
functioning of the court. The petition is taken up through video
conference on the basis of such undertaking.
The first petitioner is the husband of the victim. The three
other petitioners are close relatives of the first petitioner.
The investigation has been completed and the charge-
sheet has been filed.
Considering the materials against the first petitioner as
evident from the memorandum submitted on behalf of the State, it
may not be prudent to set him at large. However, the material
against the other three petitioners does not appear to be the same
quality. In any event, there may not be any apprehension of any
evidence been tampered with or any person being influenced by the
petitioner nos. 2, 3 and 4 if they are enlarged on bail.
Accordingly, the prayer of the first petitioner is rejected
and the petitioner nos. 2, 3 and 4 are directed to be released on
bail upon furnishing security of Rs.10,000/- (Rupees Ten
Thousand only each) and producing personal release bonds of
equivalent amount to the satisfaction of the appropriate court in
