(Allowed)
Chandrakona P.S. Case No. 337 of 2017 dated 09.12.2017 under sections

… … petitioners.
Mr. Suman Das Adhikary
… … for the petitioners.
Mr. Saswata Gopal Mukherjee, Ld. P.P.,
Ms. Amita Gaur
… … for the State.
It is submitted on behalf of the petitioners that the victim suffered
accidental fall and it is further submitted that the petitioners have been
falsely implicated in the instant case.
Learned counsel appearing for the State opposes the prayer for
anticipatory bail.
We have considered the materials in the case diary and we find
from the medical papers that the victim had suffered injury due to
accidental fall.
In view of the aforesaid facts and bearing in mind the extent of
complicity of the petitioners in the alleged crime, we are of the opinion
2
that they may be granted anticipatory bail.
Accordingly, we direct that in the event of arrest the petitioners shall
be released on bail upon furnishing a bond of Rs.10,000/‐ each with two
sureties of like amount each, to the satisfaction of the arresting officer and
also subject to the conditions as laid down under Section 438(2) of the
Code of Criminal Procedure, 1973.
This application for anticipatory bail is, thus, disposed of.
