Gwalior, Dated : 23-07-2021
Shri Awadhesh Pratap Singh Sisodiya, learned counsel for the
applicant/prosecutrix.
Shri B.S.Gour, learned PL for respondent No. 1/State.
Shri Ravi Dwivedi, learned counsel for respondent No. 2/accused.
Heard through Video Conferencing.
Prosecutrix present in person through Video Conferencing alongwith counsel
Mr. Arpita Wagh.
This is an application under Section 439 (2) of Cr.P.C. for cancellation of bail.
At the outset, prosecutrix appearing through Video Conferencing fairly submits
that she does not want to press this application. She has no problem, if the applicant
remains at large.
Learned counsel for the applicant on the basis of instructions so received affirms
the fact about withdrawal of application.
Considering the submissions, application for cancellation of bail is dismissed as
withdrawn.
Needless to say that accused/ respondent No. 2 shall not harass the prosecutrix
and shall abide by the terms and conditions as imposed by this Court in bail order
dated 20/5/2021 in M.Cr.C.No.24011/2021.
