This appeal assails the judgment dated 30.08.2019,
passed by Tenth Additional Sessions Judge, Gwalior in
Sessions Trial No. 165/2017, thereby the respondents No.1
and 2 have been acquitted from the charges of Section 376-D
of IPC.
The trial Court acquitted the respondents ignoring
the material evidence produced by the prosecution.
Therefore, we are of the considered opinion that arguable
point is involved in the present appeal, which deserves to
be admitted.
Accordingly, appeal is admitted for final hearing.
Let bailable warrants in the sum of Rs.25,000/-
(Rupees Twenty Five Thousand) be issued against each
respondents No.1 and 2 for their appearance before the
Registry of this Court on the dates to be fixed by the
Office.
