I.A. No.3163/2017, an application for condonation of delay of 4 days
in filing the appeal.

Considered.

For the reasons which find mention in the application which prevented
the appellant from filing the appeal within a period of limitation, sufficient
cause is made out. Consequently, delay condoned.

I.A. No.3163/2017 stands disposed of.
Admit.

Since the respondent No.2 is represented, no notice need be issued.

Let the matter be set out for final hearing in due course.
It is ordered that as and when directed respondent No.2 shall remain
personally present.
