ORDER

The Sagar Police have charge sheeted the

petitioner in Crime No.383/2018 for the offences

punishable under Sections 498A, 304B of IPC and

Sections 3 and 4 of Dowry Prohibition Act.

2. The marriage of the petitioner with deceased

Jyothi was solemnized on 22.04.2018. She committed

suicide on 05.08.2018 in the house of the petitioner

consuming poison. As per the charge sheet record, the

petitioner was not at home when Jyothi committed

suicide.

3. The allegations are that petitioner subjected

Jyothi to cruelty in connection with unlawful demand

for dowry. The mitigating circumstance is that father-

in-law of the victim himself admitted the victim to the

hospital. There were no external injuries on the dead

body.

4. The investigation is completed. Except for

trial, the detention of the petitioner is not required for

any other purpose. The offence is not exclusively

punishable for death or imprisonment of life. Under the

circumstances, this is a fit case to grant bail with

suitable conditions.

5. Therefore the petition is allowed. Petitioner

is granted bail in Crime No.383/2018 of Sagar Police

Station, Shivamogga District, subject to the following

conditions:

1) He shall execute personal bond in a sum of
Rs.25,000/- and furnish two sureties for the
like-sum to the satisfaction of the Court for
his appearance;

2) He shall appear before the Court as and when
required for the purpose of trial;

3) He shall not tamper the prosecution
witnesses by threats, inducement or
otherwise.
