In Re:- An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 14.01.2020 in connection
with Chakdah P. S. Case No.480 of 2019 dated 24.11.2019 under
Sections 498A/306/34 of the Indian Penal Code.

Heard the learned Advocates appearing for the parties.

It is submitted on behalf of the petitioner that the incident

occurred ten years after marriage. Petitioner is the married sister-

in-law of the victim housewife and did not ordinarily reside at the

matrimonial home of the victim housewife.

Learned Advocate appearing for the State opposes the prayer

for anticipatory bail and submits that the petitioner and the other

accused tortured the victim housewife and as a result she

committed suicide.

We have considered the materials on record. We note that the

incident occurred ten years after marriage. In view of the facts and

circumstance of the case and in the light of the aforesaid

submission that the petitioner did not ordinarily reside at the

matrimonial home of the victim housewife, we are inclined in

granting anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest the

petitioner shall be released on bail upon furnishing a bond of

Rs.10,000/- with two sureties of like amount each, to the

satisfaction of the arresting officer and subject to the conditions as

laid down under Section 438(2) of the Code of Criminal Procedure,

1973 and on condition that the petitioner shall appear before the

trial court and pray for regular bail within four weeks from date.

This application for anticipatory bail is, thus, disposed of.
