ORDER

The petitioner is the accused in Crime

No.2279/2018 of Mavelikkara Police Station for

offences pushinable under Sections 406, 420 and

498A of the Indian Penal Code.

2. The petitioner married the 3rd respondent

on 27/03/1990. After the marriage, 3 rd respondent

was residing with him at his parental house. In

the year 1991, one son presently aged 27 years

named Vishnu Mohan Kurup was born in that wedlock.

In the year 1994, the petitioner had gone abroad

for eking livelihood. The respondent No.3 is not

interested in looking after the welfare of her

husband. She filed a complaint before the Station

House Officer, Haripad Police Station in the

second week of September 2018 and crime

No.1614/2018 was registered against the petitioner

in Haripad Police Station. Thereafter it was

transferred to Mavelikkara police station and

renumbered as Crime No. 2279/2018.

3. There is some dispute between the

petitioner and the 3rd respondent regarding the

financial matters stating that nearly

Rs.40,00,000/- belongs to the 3rd respondent was

misappropriated. Any way, this is a matrimonial

dispute related to the petitioner as well as the

respondent no.3. Considering the fact of

settlement and reunion, I find it is just and

proper to grant anticipatory bail to the

petitioner.

In the result, this application is allowed and

the SHO, Mavelikkara Police Station is directed

to enlarge the petitioner on bail in the event of

his arrest on execution of a bond for Rs.50,000/-

(Rupees fifty thousand only) with two solvent

sureties each for the like sum to the satisfaction

of the Investigating Officer, subject to the

following conditions:

1.The petitioner shall appear before

investigating officer as and when required.

2.He shall not involve in any offence while

on bail.

3.He shall not influence the witnesses or

tamper any evidence in this case.

4.If he violates any of the above conditions,

the bail granted to him shall stand

cancelled, forthwith.
