This is an application filed by the husband in Matrimonial Suit No.109 of 2016

pending before the learned Additional District and Sessions Judge, Fast Track, 2nd Court

at Barrackpore, District 24 Parganas (North), praying for expeditious disposal of the said

suit.

It is submitted that the suit was filed on January 20, 2016. The application for

maintenance pendente lite was disposed of on September 14, 2016. The reconciliation

failed and issues were framed on December 20, 2016. Thereafter the suit has not

progressed although the suit was fixed for peremptory hearing. Several adjournments

have been taken by the of the opposite party in the suit. Now it appears that the cross-

examination of P.W.1 is going on.

Under such circumstances, in my opinion justice would be sub-served if the

Matrimonial Suit No.109 of 2017 pending before the learned Additional District and

Sessions Judge, Fast Track, 2nd Court at Barrackpore, District 24 Parganas (North) is

disposed of expeditiously, not later than a period of six months from the date of

communication of this order, provided that the husband/petitioner is continuing to pay

the maintenance pendente lite as directed by the learned court.

The petitioner is directed to serve a copy of the application along with a server copy

of this order upon the opposite parties within a week from date.

The revisional application is disposed of.

There will be, however, no order as to costs.

Urgent Photostat certified copy of this order, if applied for, be given to the parties

on priority basis.
