Prayer in this petition is for grant of anticipatory bail to the
petitioner in FIR No. 137 dated 17.05.2017 under Section 406/498A IPC
registered at Police Station City Barnala, District Barnala.
It is informed that the matter has been amicably resolved
during the pendency of this petition before the Mediation and Conciliation
Centre of this Court on 30.08.2017. Settlement/agreement dated 30.08.2017
is attached with the file of this case. It is informed that petition under
Section 13B of the Hindu Marriage Act, 1955 has been filed. Part of the
settled amount has been handed over to the complainant. The petitioner
undertakes to abide by the terms and conditions of the settlement. It is, thus,
prayed that this petition be allowed.
Learned counsel for the complainant affirms and verifies the
averments as above as well as receipt of the part of the settled amount. It
is submitted that the complainant has no objection, in case, this petition is

allowed subject to the petitioner adhering strictly to the terms and
conditions of the settlement.
Learned counsel for the State, on instructions from HC Baldev
Singh, verifies that the petitioner has joined investigation.
There are no allegations on behalf of the State that the
petitioner is likely to abscond or that he is likely to dissuade the
witnesses from deposing true facts in the Court, if released on bail.
Keeping in view the facts and circumstances noted above but
without expressing any opinion on the merits of case, it is considered just
and expedient to allow this petition. Consequently, order dated 05.09.2017
is made absolute.
