Heard learned counsel for the petitioner as well learned

Public Prosecutor and perused the case diary.

By the instant bail application, accused-petitioner has craved

for grant of bail in connection with FIR No.41/2017 of Police

Station Mahila Thana, Udaipur, wherein he is charged for offence

punishable under Sections 498A, 406 and 328 IPC.

Upon hearing learned counsel for the parties and perusal of

the case diary, in my opinion, the evidence collected during

investigation for slapping charge under Section 328 IPC is not of

sterling worth and it is also borne out that immediately after

incident, victim was taken to hospital by the accused-petitioner

and his family members.

Therefore, in totality of facts and circumstances of the case,

without expressing any opinion on merits of the case, I feel

inclined to grant indulgence to the petitioner.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner, Raish Khan S/o

Shri Allarakh Khan, arrested in connection with FIR No.41/2017,

Police Station Mahila Thana, District Udaipur, may be released on

bail; provided he furnishes a personal bond of Rs.50,000/- with

two surety bonds of Rs.25,000/- each to the satisfaction of

learned trial Court with the stipulation to appear before that Court

on all dates of hearing and as and when called upon to do so.
