Perused the application. Perused the FIR. Heard Mr. D.D.

Pawar, learned counsel for the applicants and Mr. R.M. Pethe, APP

for the State.

2 Informant’s daughter was married to son of present

applicant nos. 1 and 2. Applicant no.3 herein is sister-in-law of

informant’s daughter. The accusations against the applicants are

that the daughter of informant was suffering from mental torture

on account of extra marital affair of son of applicant nos. 1 and 2.

Even the applicant nos. 1 and 2 refused to persuade their son when

asked by the informant. The accusation against applicant no.3 is

that she used to instigate her brother and provoke him to beat

informant’s daughter.

3 On careful reading of the contents of the the FIR, it would

show that generalized accusations are made against the present

applicants. Except that nothing is forthcoming against them.

4 In the circumstances, ad-interim protection deserves to be

granted in favour of the applicants/accused. Hence, the following

order is passed as an ad-interim measure :

(i) In the event of arrest of the applicants/accused in

C.R.No.128/2019 registered with Malegaon Camp Police Station,

Malegaon, Nashik for the offences punishable under Sectionsections 498A,

Section306, Section323, Section504, Section506 of the Indian Penal Code, the applicants be

enlarged on bail on their furnishing PR SB in the sum of

Rs.20,000/- each.

(ii) The applicants/accused shall make themselves available for

interrogation by a police officer of concerned police station as and

when required.

(iii) The applicants/accused shall not directly or indirectly, make

any inducement, threat or promise to any person acquainted with

the facts of case so as to dissuade him from disclosing such facts to

the Court or to investigating officer.

(iv) Issue notice to the concerned police station, returnable on 16 th

January, 2020.

5 Parties and all concerned to act on authenticated copy

of this order duly issued by Personal Assistant/Sheristedar of this

Court.
