ORDER
The petitioner is the 1st accused in Crime No.81/2019
of Peroorkada Police Station which has been registered for
offences punishable under Secs.498A and 34 of the IPC. The
abovesaid crime has been registered on the basis of
complaint/first information lodged by the lady defacto
complainant Surya S.Nair, who is the wife of the petitioner
herein/A1.
2. The brief of the allegation in the above crime is that
after her marriage, the lady defacto complainant has been
subjected to cruelty and harrassment by the accused persons.
Accused No.2 has already been granted anticipatory bail by this
Court as per Annx. III order dated 12.2.2019 in BA.No.757/2019.
3. Having regard to the facts and circumstances of this
case, and also more particularly taking into account the nature of
allegations raised against the petitioner, this Court is inclined to
grant pre-arrest bail. Accordingly it is ordered that,in the event of
the petitioner being arrested by the Police in connection with the

abovesaid crime, he shall be released on bail on his executing bond
for Rs.40,000/- and on furnishing two solvent sureties for the like
sum, each to the satisfaction of the Investigating Officer concerned.
5. Further it is also ordered that it will be subject to the
following conditions:-
i. The petitioner shall not involve in any criminal offences
of similar nature.
ii. The petitioner shall fully co-operate with the
investigation.
iii. The petitioner shall report before the investigating officer
as and when required in that connection.
iv. The petitioner shall not influence witnesses or shall not
tamper or attempt to tamper evidence in any manner,
whatsoever.
If there is any violation of the abovesaid conditions by the
petitioner, then the jurisdictional court concerned stand hereby
empowered, to consider the plea for cancellation of bail at the
appropriate time.
With these observations and directions, the above Bail
Application will stand disposed of.
