The present bail application has been filed under Section 439

Cr.P.C. on behalf of the petitioner, who is in custody in relation to

F.I.R. No.122/2017, P.S. Amba Mata, Udaipur, for the offence

under Section 354 I.P.C.

Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

The F.I.R. was lodged after two days of the incident. In

complainant’s statements recorded under Section 161 and 164

Cr.P.C., she alleged that she approached the massage centre of

the present petitioner with a complaint of having back pain. As per

the allegation set out in the statement recorded under Section 164

Cr.P.C., the petitioner is alleged to have started pressing the

pressure points of the complainant and then allegedly grabbed her

hips. The complainant raised a hue and cry that she had not

allowed the petitioner to do so and thereafter, ran out of the

centre.

Having regard to the entirety of facts and circumstances as

available on record and upon a consideration of the arguments

advanced at the Bar, but without commenting on the merits of the

case, this Court is of the opinion that the petitioner deserves to be

enlarged on bail.

Consequently, the bail application is allowed. It is ordered

that the accused-petitioner namely Rajendra Kumar @ Raju

arrested in connection with F.I.R. No.122/2017, P.S. Amba Mata,

Udaipur shall be released on bail; provided he furnishes a personal

bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to

the satisfaction of the learned trial court with the stipulation to

appear before that Court on all dates of hearing and as and when

called upon to do so.
