Learned counsel for the applicant submitted that the accused-applicant has falsely been implicated in the present case. It has further been submitted that as per educational certificate, the age of the prosecutrix is 15 years and as per medical report 18 years. The FIR has been lodged by the prosecutrix herself and the avernment therein merely indicates offence under Section 354 IPC. The same allegation has been levelled against the applicant in the statement of the prosecutrix and her mother recorded under Section 161 Cr.P.C., however charge sheet has been submitted on the premise of her statement under Section 164 Cr.P.C. alleging rape against the applicant, though the aforesaid statement of the prosecutrix is too vague to level charge under Section 376 IPC. against the applicant. The medical examination of the prosecutrix does not support the prosecution case. The accused-applicant is languishing in jail since 02.11.2019 having no criminal history. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail.
Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant.
