The present appeal has arisen from the judgment and decree
dated 26.08.2016 passed by Additional Civil Judge (Senior Division),
Bathinda vide which application filed under Section 25 of the Guardian and
Wards Act 1890 read with Section 6 sub Clause (a) of the Hindu Minority
and Guardianship Act, 1956 by the wife for seeking custody of the minor
child namely Shivam Kumar was dismissed.
During the pendency of this appeal, matter was referred to the
Mediation and Conciliation Centre of this Court where both the parties have
entered into a compromise which was reduced into writing on 24.01.2019
and it was decided therein that the custody of the minor child would remain
with the respondent-father and the appellant-mother would have the
visitation rights.
Counsel for the appellant is not present. It appears that the
appellant has lost interest in this case after the said settlement.
Therefore, present appeal is hereby dismissed as having been
rendered infructuous in view of the aforesaid settement. Still liberty is

granted to the appellant to file an appropriate application for revival of this
appeal, in case, parties to the settlement resile from it.
