It is submitted on behalf of the petitioners that petitioner
no.1 is the brother-in-law of the victim and petitioner no.2 is the
wife of the victim and they have been falsely implicated in the
Learned counsel appearing on behalf of the State opposes
the prayer for anticipatory bail.
We have considered the materials on record particularly
the statement of the son of the victim who speaks of quarrel
between the mother-in-law and the victim on that day and
keeping in mind the extent of complicity of the petitioners in the
alleged crime, we are inclined to grant anticipatory bail to the
In the event of arrest, the petitioners shall be released on
bail upon furnishing a Bond of Rs. 10,000/- each with two
sureties of like amount each to the satisfaction of the Arresting
Officer and also subject to the conditions as laid down under
Section 438(2) of the Code of Criminal Procedure, 1973 and on
further condition that petitioner no.1 shall meet the investigating
officer once in a week until further orders.
The application for anticipatory bail is, thus, disposed of.
