Prayer in this petition is for grant of anticipatory bail to the

petitioners in FIR No. 22 dated 12.01.2017 registered under Sections 498A,

406, 506 IPC at Police Station City Jagadhri.

Learned counsel for the petitioners submits that the matter has

been amicably resolved between the parties. The terms and conditions of the

settlement were reduced into writing on 28.04.2017. This fact could not be

brought to the notice of the Court when the matter was listed on 28.04.2017

as the same was not communicated to learned counsel till then. Photocopies

of the said settlement alongwith the affidavits of respondent No. 2 and

petitioner No. 2 produced in Court today are taken on record subject to just

exceptions. The parties, it is submitted, have decided to part ways. A

petition under Section 13B of the Hindu Marriage Act, 1955 shall be filed

by respondent No. 2 and petitioner No. 2. It is, thus, prayed that this petition

be allowed.

Learned counsel for the State, on instructions from ASI Mehar

Singh verifies that the matter has been amicably resolved. It is informed

that cancellation report has been prepared on 15.06.2017.

Keeping in view the facts and circumstances noted above but

without expressing any opinion on the merits of case, it is considered just

and expedient to allow this petition. Consequently, order dated 08.03.2017

is made absolute.

However, liberty is afforded to respondent No.2 to move an

appropriate application, in case, any of the facts mentioned above are not

correct.

A sum of `25,000/- deposited as litigation expenses in

compliance with order dated 08.03.2017 be released to respondent No. 2

against adequate proof of identity.
