Petitioner has filed this 2nd petition under Section
439 Code of Criminal Procedure, 1973 seeking regular bail in
F.I.R. No.87/2017 registered at Police Station Niwai, District
Tonk for offence under Sections 341, 342, 354 Indian Penal
Code, 1860 and Sections 7 8 of Protection of Children from
Sexual Offences Act, 2012.
Learned counsel for the petitioner has submitted
that the petitioner is in custody since 17.03.2017. Challan has
already been presented in the court. Co-accused Kalu Ram
against whom allegation under Section 354 Indian Penal
Code, 1860 had been levelled, has been granted bail by co-
ordinate Bench of this court.
Learned State Counsel on the other hand, has
opposed the petition.

Keeping in view the facts and circumstances of the
case, it would be just and expedient to order the release of
the petitioner on bail.
Accordingly. without expressing any opinion on the
merits of the case, this petition is allowed. Petitioner be
admitted to bail subject to satisfaction of the Trial Court.
