The instant application under Section 482 of the Code of

Criminal Procedure has been filed for quashing the F.I.R. of

Jehanabad Mahila P.S. case no. 58 of 2013 dated 3.8.2013

lodged under Sections 498A, 313, 323 and 504 of the Indian

Penal Code mainly on the ground that the place of occurrence

does not lie within the jurisdiction of Jehanabad District.

The petitioner is the husband of the opposite party no.4

(informant).

In the written report, the informant has alleged that after

marriage when she went to her matrimonial house, she was

tortured and assaulted by this petitioner who was the husband.

She became pregnant and during pregnancy she was tortured

and abortion took place. On account of such torture, she was

finally ousted from the matrimonial house of this petitioner

and she is, at present, living in her ‘Naihar’ in Jehanabad with

her parents.

In the written report, it is alleged that the informant was

brought to her ‘Naihar’ in Jehanabad by her husband and he

left her there while she was again pregnant.

In such circumstances, this Court does not find any

illegality in filing the F.I.R. in Jehanabad.

This Cr. Misc. application is, accordingly, dismissed.
