Heard learned counsel for the petitioner as well as learned
Public Prosecutor and also perused the material on record.
The petitioner has been arrested in connection with FIR
No.45/2017 of Police Station Panchu (Bikaner), for the offence
punishable under Sections 498A, 304B, 302, 34 of IPC. He has
preferred this bail application under Section 439 Cr.P.C.
Counsel for the petitioner submits that the other co-accused
have been already granted bail by this Court. The accused-
petitioner is in judicial custody and the trial of the case will take
sufficient long time to be concluded. Therefore, the benefit of bail
should be granted to the accused-petitioner.
Learned Public Prosecutor has opposed the bail application.
In this case, a six months’ pregnant lady has expired in her
in-law’s house within a period of seven years of her marriage. The

other co-accused were granted bail by this Court because they are
mother-in-law, father-in-law and brother-in-law of the deceased.
The petitioner is the husband of the deceased, who is the main
accused.
After considering the facts and circumstances of the case, no
case is made out for grant of bail under Section 439 Cr.P.C. at this
stage.
Accordingly, the Criminal Misc. Bail Application is hereby
rejected at this stage. However, trial court is directed to record the
statements of Ramlal and Lali Devi as early as possible.
