At the instance of opposite party no.2, Sweta Sureka nee

Agarwal, the Lake Town Police Station Case No.112 of 2015 dated

10th May, 2015 under Sections 498A/406 read with Section 3 and 4

of the Dowry Prohibition Act corresponding to G.R. No.418 of 2015 in

which the Charge Sheet No.79 of 2017 dated 22nd May, 2017 was

submitted and the matter is pending for hearing before the learned

Additional Chief Judicial Magistrate, Bidhannagar, North 24

Parganas. The parties to the case mainly the defacto complainant

being the opposite party no.2 has entered into a joint compromise

and have arrived at a mutual consent for a decree of divorce already

filed before the District Judge, Barasat.

In view of the mutual compromise and understanding arrived at,

I do not find any reason for continuation of the proceeding before the

Magistrate.

So, in order to prevent the abuse of process of the Court the

revisional application and CRAN No.1768 of 2018 is allowed and

disposed of. Consequently, the proceeding being Lake Town Police

Station Case No.112 of 2015 dated 10th May, 2015 under Sections

498A/406 read with Section 3 and 4 of the Dowry Prohibition Act

corresponding to G.R. No.418 of 2015 and the Charge Sheet No.79 of

2017 dated 22nd May, 2017 pending before the learned Additional

Chief Judicial Magistrate, Bidhannagar, North 24 Parganas is

quashed.

Urgent photostat certified copy of this order, if applied for, shall

be given to the parties as expeditiously as possible.
