Junput Coastal P.S. Case No.08 of 2016 dated 18/03/2016
under Sections 498A/304B/34 of the Indian Penal Code and
ssd added Section 302 and Sections 3/4 Dowry Prohibition Act,
1961.

The petitioner seeks bail in connection with Junput Coastal P.S. Case

No.08 of 2016 dated 18/03/2016 under Sections 498A/304B/34 of the

Indian Penal Code and added Section 302 and Sections 3/4 Dowry Prohibition

Act, 1961.

The petitioner is the uncle of the husband of the victim who suffered

an unnatural death within a few years of her marriage. The post-mortem

report indicates that the death was homicidal in nature.

The State produces the case diary and refers to statements obtained

from neighbours to the effect that the petitioner would inflict torture on the

victim upon the victim’s failure to obtain more dowry. However, there is

nothing that links the petitioner to the incident which led to the death of the

victim. The State says that the petitioner had been absconding for a

considerable period and was arrested only on January 26, 2019.

Considering the material against the petitioner, he is entitled to bail.

However, the petitioner will be subjected to more stringent conditions
