sg/ks Ct. No.36 In Re: – An application for anticipatory bail under Section 438 of the Code of Criminal
Procedure filed on 30-05-2019 in connection with Jangipara P.S. Case No. 133/2018
(Allowed) dated 18.06.2018 under Sections 498A/Section306/Section302/Section34 of the Indian Penal Code.

Ranajit Bandopadhyay @ Ranjit Banerjee Ors.

Versus
State of West Bengal

Md. Shahjahan Hossain, Adv.

Vacation Ms. S. Sultana, Adv.

Bench …for the petitioners
Mr. Sanjay Bardhan, Adv.
Ms. Trina Mitra, Adv.
…for the State

It is submitted that the petitioners are the in-laws of the victim housewife and

it is submitted that there is inordinate delay in lodging the first information report. It

is further submitted that the victim accidentally caught fire and died.

Learned lawyer for the State opposes the prayer for anticipatory bail and

submits that the principal accused i.e. the husband is absconding.

We have considered the materials on record and bearing in mind the nature

of allegations in the light of the aforesaid submissions including the noting in the

medical papers at page 35 of the case diary that the victim had accidentally caught

fire, we are inclined in granting anticipatory bail to the petitioners.

In the event of arrest, the petitioners shall be released on bail upon furnishing

bond of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of like

amount each to the satisfaction of the arresting officer subject to the conditions as laid

down under Section 438(2) of the Code of Criminal Procedure, 1973 and they shall

appear before the court below and pray for regular bail within a period of four weeks

from date.

The application for anticipatory bail is, accordingly, allowed.

Urgent photostat certified copy of this order, if applied for, be supplied

expeditiously after complying with all necessary legal formalities.
