1. Heard the learned counsel for the applicant and the learned APP for
the State.
2. The applicant apprehends arrest in C.R. No.119 of 2019 registered
with Navghar Police Station, at Bhyandar East, for the offences punishable
under Sections 323, 406, 498A, 504, 506 read with Section 34 of the
Indian Penal Code, 1860 for having, inter-alia, subjected his wife to
cruelty.
3. The learned Sessions Judge was persuaded to grant the benefit of
pre-arrest bail to the relatives of the applicant. However, the learned
Sessions Judge observed that material allegations have been made against

the applicant-husband and, therefore, the learned Session Judge was not
persuaded to exercise the discretion in favour of the applicant.
4. From the perusal of the material on record, it becomes evident that
the offence has its genesis in matrimonial discord. Certain complaints have
also been lodged by the applicant against the first informant. The Stridhan
appears to have been recovered. It seems that custodial interrogation is not
imperative for effective investigation. Thus, having regard to the nature of
allegations, gravity of offence and the role attributed to the applicant, a
prima-facie case for grant of interim protection is made out. Hence, the
following order :-
ORDER
(i) In the event of arrest in C.R. No. 119 of 2019
registered with Navghar Police Station, the applicant-
Ranjeet Kishan Singh be released on bail on furnishing a P.
R. Bond of Rs.15,000/- and a surety in the like amount.
(ii) The applicant shall attend Navghar Police Station
on every alternate Sunday from 11.00 a.m. to 1.00 p.m.
till filing of the charge-sheet.
(iii) The applicant shall not tamper with prosecution

evidence and/or threaten or induce the prosecution
witnesses.
(iv) Post the matter before the regular Court on 24 th
June 2019.
