The petitioner is seeking regular bail in FIR No. 191 dated

6.12.2017 registered at Police Station Morinda, District Roopnagar under

Sections 354 IPC.

Counsel for the petitioner contends that petitioner is in custody

since 27.2.2018 and the FIR has been lodged with respect to an incident

which occurred in 2015. The counsel further submits that there was a

property dispute after the petitioner’s son had died and a suit was filed and

the litigation is pending. Counsel also submits that the statement of the

prosecutrix has also been recorded and the complainant is living separately

and not in his house and the trial would take time and the allegations are

under Section 354 IPC.

The case had been adjourned on the last date of hearing to

enable the prosecution to record the statement of the prosecutrix. Statement

of the prosecutrix has been recorded. This fact is not disputed by the State

counsel. The trial would take time.

Without commenting anything on the merits of the case, the

petition is allowed and the petitioner is ordered to be released on bail on his

furnishing bail/surety bonds to the satisfaction of the trial Court/Duty

Magistrate.
