17. 16.02 W.P. 3095 (W) of 2018
Sd3 2018
Ratan Thander Anr.
Versus
The State of West Bengal Ors.
Mr. Debabrata Ray
Ms. Kasabi Ray
…for the petitioners.
Mr. Ayan Bhattacharyya
Mr. Rohit Islam
…for the respondent nos.6 7
Mr. Sakhya Sen
Mr. Amritalal Chatterjee
…for the State
The two petitioners are before Court claiming
themselves to be senior citizens and being maltreated by
the private respondents.
The State and the private respondents are
represented.
Learned advocate for the State submits that, so far
as the complaint lodged by the petitioner is concerned, a
First Information Report was registered and a charge-
sheet filed in respect thereto.
Learned advocate for the private respondents
submits that, the present writ petition is a subterfuge for
the purpose of dealing with a pending proceeding under
Section 498A of the Indian Penal Code against the
petitioners. One of the petitioners is absconding.
There appears to be substance in the contentions
raised on behalf of the private respondents. One of the
accused is yet to be apprehended.
This fact was not brought to the notice of the Court
during the course of submission made on behalf of the
petitioner.
2
This conduct on the part of the petitioners is yet
appreciated.
In the facts of the present case, I am not minded to
interfere. Moreover, the complaints of the petitioners have
resulted in a charge-sheet. They have alternative remedies
should they have any justifiable grievances in respect of
the charge-sheet filed.
W.P. No. 3095 (W) of 2018 is dismissed.
No order as to costs.
Urgent certified Website copy of this order, if
applied, be supplied to the parties, upon compliance of all
requisite formalities.
