Judgment
16/01/2019
Petitioner has filed this petition under Section 438 Code
of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R.
No.611/2018 registered at Police Station Tijara, Alwar for
offence under Section 354 Indian Penal Code, 1860.
Learned counsel for the petitioner has submitted that
the petitioner as well as the complainant are working as
lecturars in the college. Petitioner has been falsely involved
in this case by levelling false allegations. Petitioner has
joined investigation.
Learned state counsel who is assisted by the counsel
for the complainant, has opposed the petition. Learned
counsel for the complainant has submitted that on earlier
occasions also complaints had been received against the
petitioner from various girl students. It’s a girls college in a
(2 of 2)
small municipality. Petitioner has misbehaved with the
complainant by outraging her modesty.
Although, petitioner has joined investigation, but
keeping in view the seriousness of the allegations levelled
against the petitioner, no ground for grant of anticipatory bail
to him is made out.
Dismissed.
