In Re: – An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 28/06/2019 in
connection with Jagaddal P.S. Case No. 7 of 2019 dated
03/01/2019 under Sections 498A/Section304B of the Indian Penal
Code.
And
In the matter of: Rekha Mondal
….petitioner.
Mr. S. K. Deb
…for the petitioner.
Mr. R. R. Chowdhury,
Mr. M. Gupta
…for the State.
It is submitted on behalf of the petitioner that co-accused
person has been granted anticipatory bail and the principal accused
i.e. the husband is on regular bail.
Learned counsel appearing on behalf of the State opposes the
prayer for anticipatory bail.
Having considered the materials in the case diary and bearing
in mind the extent of complicity of the petitioner in the alleged crime
and the fact that petitioner is similarly circumstanced with the co-
accused person who has been granted anticipatory bail, we are inclined
to extent the same privilege to the petitioner.
In the event of arrest, the petitioner shall be released on bail
upon furnishing a Bond of Rs. 10,000/- with two sureties of like
amount each to the satisfaction of the Arresting Officer and also be
subject to the conditions as laid down under Section 438(2) of the Code
of Criminal Procedure, 1973 and on further condition that she shall
appear before the court below and pray for regular bail within a
fortnight from date.
The application for anticipatory bail is, thus, disposed of.
